You’ll Always Call It AI

FNMedia · November 6, 2026 ·

Let’s be honest about one thing: regular human beings are never going to call this stuff “Super Intelligence” or “SI.”

It doesn’t matter what executive orders come out of Washington, what defense briefs declare, or what rebranding Silicon Valley tries to pull. To 99% of the population, it will always be “AI.” You ask Gemini for a recipe, you tell Grok to debug an Excel formula, you generate an image, and you move on with your day.

The tech giants and the feds know you don’t care about their new labels. In fact, they’re banking on it.

While everyday users treat AI like an upgraded Google search box, the federal government quietly updated its books to classify frontier models as national strategic assets—and shifted the legal and operational ground right beneath your feet.

If you run a business, manage an infrastructure, or even just use autonomous tools to handle your daily workload, here is why you cannot afford to tune this out.

1. “The Robot Did It” Is Officially Dead as a Legal Defense

Until recently, if an algorithm scraped bad data, spit out an error, or messed up a client delivery, people treated it like software bugs of the past: blame the vendor, contact customer support, move on.

That era is over. The Department of Justice and federal enforcement agencies are now aggressively applying existing federal computer fraud statutes (like 18 U.S.C. § 1030) directly to autonomous agent deployment.

When you set an automated script or multi-agent workflow loose to:

  • Scrape competitor directories or market data
  • Automate outreach and database syncs
  • Execute server management or code deployments without human review

…the law views that tool as your digital employee.

If your automated agent hits a protected endpoint, bypasses an authentication wall, or mishandles private consumer data, the platform that built the model has zero liability. You hit run. You hold the legal bag.

2. Your Electric Bill Is Subsidizing the Race

Most people think artificial intelligence lives invisibly in “the cloud.” It doesn’t. It lives in massive concrete warehouses packed with high-draw silicon running 24/7/365, consuming jaw-dropping amounts of power and municipal water just to stay cool.

While the talking heads argue about chatbots on TV, the real war is happening at local township meetings and public utility commissions:

  • Communities across the Midwest and East Coast are passing emergency zoning freezes and moratoriums on data centers because local grids are buckling.
  • When hyperscalers plug gigawatt-scale infrastructure into regional utility lines, the cost to upgrade substations and high-voltage transmission lines doesn’t come out of Silicon Valley’s pocket—it gets socialized across commercial and residential ratepayers.
  • Tech giants are now cutting deals to buy up entire private nuclear generators just to secure power behind the meter.

Whether you use these tools daily or avoid them entirely, you are paying for the compute race every time you open your monthly electric statement.

3. Federal Gridlock vs. The 50-State Compliance Minefield

Washington operates on high-level executive orders, national defense posture, and voluntary tech commitments. They want American compute to move as fast as possible, so federal agencies have largely avoided imposing strict licensing roadblocks or pre-clearance rules.

Because the federal government stepped back from consumer protection, state legislatures stepped in:

  • Digital Identity Rights: States like Tennessee and Montana passed laws making your face and voice enforceable personal property, opening direct civil liability for unauthorized cloning.
  • Strict Platform Liability: States like Minnesota and Texas enacted hard financial penalties (up to hundreds of thousands of dollars per incident) for deceptive bots, automated profiling without opt-outs, and non-consensual synthetic media.
  • Local Data Audits: Operating a business across state lines now means complying with dozens of conflicting state rules governing automated decision-making and consumer privacy.

The Bottom Line for Business Operators

Call it AI. Call it a chatbot. Call it whatever you want.

The terminology doesn’t change the operational reality:

  1. Audit what your automated tools are actually touching. If you deploy agentic workflows or automated scrapers, ensure there is a clear human-in-the-loop audit trail.
  2. Watch your infrastructure and vendor contracts. Don’t assume cloud software vendors cover your liability when their systems make mistakes on your behalf.
  3. Recognize that the physical costs are real. Compute is no longer free or cheap; energy constraints are dictating where technology companies can build and who pays for the power.

The technology isn’t just generating text anymore—it’s driving real-world physical and legal consequences. Treat it like heavy machinery, because that’s exactly how the regulators and courts are looking at it.
